Your bank may have already offered to sign a document with the electronic signature. Unless it is your notary who uses it, a real estate agent, or your pension insurer. More and more SMEs and VSEs are also equipping themselves with an electronic signature solution. It may therefore be that it is a carpenter, a roofer, or any other craftsman who has come to do work at your home who has offered to sign an estimate or an invoice thanks to the e-signature.
And if you haven’t already, it won’t be long: the electronic signature is still something relatively new for individuals, but the opportunities to use it are increasing. Since the health crisis, the dematerialization of companies has accelerated, and whatever their sector, French companies are equipping themselves with electronic signature.
The advantages of the electronic signature for professionals and their clients
It simplifies everyone’s life, and saves valuable time for both professionals and their clients.
All sectors are concerned, as well as banking, insurance, construction, or real estate, for example. In fact, every company can see a use for it one day or another. If, in your entourage, a relative or a neighbor has just been hired, it is possible that he has signed his promise of employment, or his employment contract in this way, whether it is a CDD, a CDI, or an interim contract.
Unless it’s the confidentiality clause of his future employer. Indeed, since the electronic signature is secure, even confidentiality agreements can be signed through it!
Electronic signature: time saved
Thanks to the electronic signature, it is no longer necessary to wait to receive a document by post (or to have to print it if it was received by email), to sign it, and to send it back (possibly a times scanned). This process can sometimes take several days, between printing the document (sometimes at the cybercafé or at the print shop in a nearby town, when you don’t have a printer), scanning it, or moving it to La Poste to send it back.
When you live in the countryside, all this is even more complicated. That’s not counting gas costs.
With the electronic signature, signing a digital document is done in a few clicks, without having to move! This is enough for both parties to give their consent. Distance and time no longer exist, everything becomes almost automatic, and so fluid!
In addition, it allows everyone to save ink, paper, and postage.
How the electronic signature works for the customer
As a customer, you have nothing to do. It is the company that asks you to sign the document online. You receive an OTP (One-Time Password) code by SMS to the predefined number, in order to confirm your identity and your decision to sign the document.
Following this, an electronic certificate guaranteeing the integrity of the document is affixed to the document.
It is partly thanks to this that the electronic signature, even on a PDF, has guaranteed legal value and is recognized by the European authorities.
To sign, you do not need to be in front of your computer at home. You can also sign from your mobile phone, provided you have an internet connection.
Most documents sent are returned signed to the sender within minutes. For more security, the traceability of each document is ensured. Each document is then frozen in time, and there is no going back.
The electronic signature: why companies appreciate it
The electronic signature is used in many contexts, for example:
- For commercial documents;
- With suppliers;
- For HR documents (human resources) such as employment contracts or health insurance;
- For the signing of the company’s internal regulations;
- Insurers use it to send all types of contracts to their customers: life insurance, car insurance, home insurance, etc.
- It is also useful in real estate, for sales agreements, inventory of fixtures, rental leases, real estate sales contracts, etc.
In the case of the sales agreement, the advanced electronic signature will be used, because it requires more verification than a simple signature. Here, the signatory will have to prove his identity before being able to sign.
The advanced electronic signature is one of the three levels of electronic signature defined by the European regulations on electronic identification and trust services for electronic transactions (known as eIDAS regulations).
