eIDAS facilitates the deployment of electronic signature for European companies

Accelerate the digitalization of companies and make any internal or external administrative process more fluid, faster; this is the mission of the eIDAS regulation which will be updated. This legal advance is reflected in particular by an enrichment of new qualified services including the electronic signature.

Medical documents, payslips, quotes, contracts… So many confidential, personal and professional documents, now governed by greater single European digital legislation. This novelty, which also aims to simplify any digital task, is made possible by a recent proposal to modify the eiDAS regulation, n° 910/2014, of June 3, 2021. The digitization of European territory is indeed underway and operates on all digital tools with the electronic signature as a priority.

What are the ambitions of this update of the eIDAS regulation?

Like a fingerprint or a DNA sample, electronic identification is nominative and must make it possible to differentiate one individual from another under the law. It contains personal identification data used to authenticate to online services. Faced with a proliferation of electronic identification needs and solutions, the European Union wishes to better regulate legislation in the digital field. In this context, the eIDAS regulation aims to accelerate the digital transformation of European companies and organizations to optimize electronic transactions and thus make them more fluid, faster and secure.

These modifications to the European eIDAS regulation dating from 2021 include new points, such as:

  • Abolish digital borders in terms of jurisdiction through access to highly secure and reliable electronic identity solutions,
  • Enable public and private services to rely on a reliable and secure digital identity,
  • To offer European citizens the possibility of being authorized to use digital identity solutions, such as electronic signature,
  • Give citizens and businesses in the euro zone the necessary legal framework to control their own digital space (the secure storage and disclosure of digital identity data),
  • Adapt to specific sector needs, when identification requires a high degree of certainty. For example in the case of court decisions, bank signatures, patent filing signatures.

Today, only 59% of EU residents have access to reliable and secure electronic identification solutions across borders, as evidenced by the European Parliament’s amendment request report n°910/2014 . The current list of eIDAS trust services will therefore be supplemented in its new version by three new priority qualified trust services:

  • The provision of electronic archiving services,
  • The establishment of electronic registers,
  • The management of the creation of signatures, but also of remote electronic seals.

These digital solutions do not only concern the democratization of the use of the electronic signature, they also allow the sharing of identity data for any administrative procedure, within the European digital zone. Moreover, both public and private sector players will be required to use these mechanisms.
